She has successfully resolved numerous lawsuits, administrative charges, and informal disputes, employing both successful advocacy and skillful negotiation to cost-effectively achieve desired results. Heather has significant experience litigating or otherwise resolving disputes arising under state and federal law including discrimination, harassment, retaliation, wrongful termination in violation of public policy, and employer intentional torts. Heather pursues enforcement of employers' rights in matters involving non-solicitation or non-competition agreements, misappropriation of trade secrets, unfair competition and tortious interference. Heather also regularly represents employers and third party administrators in ERISA litigation.
Heather advises businesses in a variety of sensitive employment matters. She works closely with her clients to develop policies, strategies and best practices to pursue legitimate business objectives while minimizing exposure to liability. She has experience in conducting and advising businesses conducting workplace investigations and has handled I-9 compliance audits.
Heather also advises clients regarding data privacy and network security concerns to ensure compliance with a variety of state and federal laws. Heather has experience defending individual and class action lawsuits arising from alleged data breaches.
Heather's litigation experience in state and federal courts throughout the region at the trial and appellate level includes more general commercial litigation. She has successfully defended and pursued shareholder disputes, contract-related claims, and claims arising in connection with bankruptcy proceedings.
